These terms and conditions ("Terms") govern your use of Steward, an identity-driven habit tracking application ("the Service") provided by KINETIK MOTION DESIGNED (PTY) LTD ("we", "us", "the Seller"). By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, please stop using the Service.
Steward is a personal habit-tracking application that stores your data locally on your own device. The core Service is provided free of charge, with no advertisements, and no payments are currently processed through the Service.
Certain optional features run on our cloud infrastructure, namely push reminders, account creation and multi-device sync ("Cloud Features"). Cloud Features are described in section 7 and are currently provided free of charge as an early-access test.
By using the Service you confirm that you are of legal age in your jurisdiction, or that you have the consent of a parent or guardian, and that you have the authority to agree to these Terms.
You must not misuse the Service. In particular, you must not:
The Seller retains all ownership of the Service and its intellectual property, including the software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for personal, non-commercial purposes. You may not reverse engineer, resell, redistribute, or circumvent any technical limitations of the Service.
Your habit and profile data is stored on your own device. You are responsible for keeping backups (the Service provides export and import tools for this purpose) and for the accuracy of the information you enter.
Push reminders are currently offered to early users as a free test feature. Because Cloud Features carry ongoing server costs, we intend to make them part of a paid Pro subscriptionin future, together with account creation and multi-device sync.
We may change, suspend or withdraw Cloud Features, or move them to a paid subscription, at any time. Where we move a Cloud Feature to a paid plan we will give reasonable notice in the app and publish pricing on our Pricing Policy page beforehand. Test features may be less reliable than the rest of the Service and are provided without any delivery guarantee.
You are never required to subscribe. Without a subscription, Steward remains fully usable on your device, including habits, identities, streaks, grace shields, the friction log and reflections.
No payments are currently processed through the Service. Steward's core features are free, and no support prompts are shown at this time.
When paid Pro features (such as cloud-based reminders, accounts and multi-device sync) launch in future, the payment provider, subscription mechanics, cancellation terms and refund terms will be published on our Pricing Policy and Refund Policy pages before any charge begins, and these Terms will be updated accordingly.
The Service is provided "as is" and "as available". We do not guarantee uninterrupted, timely, or error-free performance, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.
To the fullest extent permitted by law, we exclude liability for any indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability to you is capped at the amount you have paid to us in the 12 months preceding the claim, if anything. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.
We may suspend or terminate access to the Service where you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate these policies. Because your data is stored on your own device, you may export it at any time before or after termination using the built-in export tool.
These Terms are governed by the laws of South Africa, and any disputes will be subject to the courts of South Africa. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control. If any provision is found unenforceable, the remainder continues in effect.
